1. Introduction:
These Terms and Conditions ("Terms") apply to the use of the online grocery delivery service ("Service") provided by Urban Mart ("Urban Mart", "us", "we", or "our"). By accessing or using the Service, you ("User", "you" or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Eligibility:
The Service is intended solely for persons who are 18 or older and residing twin cities of Rawalpindi and Islamabad. By using the Service, you represent and warrant that you are 18 or older.
3. Service Description:
Urban Mart offers an online grocery delivery service that allows users to place orders for groceries and other household items and have them delivered to their desired location. The Service is accessible through the Urban Mart website or mobile application.
4. Order Placement:
To place an order, you must create an account on the Urban Mart website or mobile application. Once you have created an account, you may select items and add them to your cart. After you have finished selecting items, you may proceed to checkout and submit your order.
5. Payment:
Urban Mart only accepts cash on delivery (COD) as a payment method. Payment must be made in full at the time of delivery, and only in the currency specified on the order i.e PKR. We do not accept checks, credit or debit cards or any other form of payment.
6. Delivery:
Urban Mart will use reasonable efforts to deliver orders next day and time provided at the time of checkout. However, delivery times may vary depending on the availability of products and the delivery location. Delivery is available limited areas of Rawalpindi and Islamabad. Urban Mart will not be liable for any delay in delivery. Urban Mart reserves right to cancel an order due to delivery issues without any justification.
7. Returns & Refunds:
If you are not satisfied with your order, you may contact Urban Mart customer service within 24 hours of receiving your order to request a return or refund. Urban Mart reserves the right to refuse any return or refund request if it determines that the request is unreasonable or if the product has been opened or used.
8. User Conduct:
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the Service to purchase items for resale or commercial use. Urban Mart reserves the right to terminate your account and prohibit your use of the Service if you violate these terms.
9. Disclaimer of Warranties:
The Service is provided on an "as is" and "as available" basis. Urban Mart makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.
10. Limitation of Liability:
In no event shall Urban Mart, its directors, officers, employees, agents, partners or suppliers be liable for any damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Service.
11. Governing Law:
These terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan without giving effect to any principles of conflicts of law.
12. Changes to the Terms:
Urban Mart reserves the right to make changes to these terms at any time with or without any prior notification. Your continued use of the Service following the posting of changes to these terms will mean you accept those changes.
